The purchase price should be settled in full at the point of invoice but no later than 5 days
No lot can be moved until cheques have been cleared or payment has been received in full by Stags
The Purchaser shall commit no wilful or unnecessary damage to the gateposts, gates, hedges, ditches, fences (live or dead), fruit or other trees, or to the surfaces of the land, and shall comply with the rules of good husbandry. Any damage to be made good immediately by the Purchaser or a sum of compensation paid to the Vendor for such damage as determined by the Vendor’s agent. The charges or expenses incurred by such a valuation also to be paid by the Purchaser.
The purchaser is responsible for a lot from the time of notification of completion of combining of each lot. The Vendor will also be responsible for contacting the Purchaser of each lot as soon as combining is completed.
The Purchasers will be responsible for clearing the straw from the land within 21 days of the day on which combining finishes unless earlier clearance is stated. Where the straw is not removed by the Purchaser within 21 days the vendor shall be entitled to recover the costs of clearance on top of the purchase price from the Purchaser.
For wholecrop or standing maize the Purchaser is responsible for clearing the crop by the deadline stated. Where the crop is not removed by the deadline stated the vendor shall be entitled to recover the costs of clearance on top of the purchase price from the Purchaser.
The area of each lot is believed to be correct and is given based upon information provided by the Vendor. The Auctioneers do not guarantee the area and the Purchaser must satisfy themselves of acreage by prior inspection of each lot.
The purchaser must satisfy themselves to the quality of each lot. Any faults, errors or mis descriptions will not alter any agreed upon sale price or annul the sale.
Each Lot has been lotted as detailed in the catalogue but the Auctioneers reserve the right to withdraw any lot, subdivide or amalgamate any lots as they think fit.
Each lot will be sold on a “price per acre” basis. For part acreage’s the area shall be calculated by rounding down to the nearest half acre (i.e. 12.4 acres will be rounded to 12 acres and 16.9 acres will be calculated as 16.5 acres)
The Auctioneers act only as agents for the Vendor, they shall not be considered personally or wholly responsible for any default on the part of the Purchaser or Vendor.
It is assumed the straw will be suitable for use of feeding purposes, unless notified otherwise by the Purchaser.
Purchasers must ensure all balers are thoroughly cleaned prior to entry on to the Vendors land, to mitigate the spread of weeds, such as black grass. Vendors can reserve the right to inspect balers prior to allowing entry.
In the case of any dispute between the Vendor and Purchaser, the Auctioneers decision will be final and binding.
All purchases or agents of must have adequate employees and relevant insurances. Both the auctioneers and Vendors reserves the right to ask for such information and proof.
